Illinois licensing and the permit process
The Illinois Department of Public Health licenses ASTCs under the Ambulatory Surgical Treatment Center Act (210 ILCS 5) and 77 Ill. Adm. Code 205. Separately, the Health Facilities and Services Review Board runs the state’s certificate-of-need program. Establishing a new ASTC requires a Board permit, and capital projects above the threshold ($4,779,437 as of July 1, 2026) are reviewed too.
That process sets the calendar for many Chicago-area projects. A rental keeps rooms running while a permit, a purchase or a build-out is pending. Whether a particular lease needs Board review is a question for your health care counsel.
Equipment rules under 77 Ill. Adm. Code 205
Section 205.410 requires equipment in good working order and in sufficient supply, monitoring, suction and oxygen in the surgical and recovery areas, and handling of inhalation anesthetics and medical gases under NFPA 99. A rented anesthesia machine is held to the same standard as an owned one, and we send its service history with the quote.
